The McCloud remedy
We recently wrote to members who may be affected by the recent changes to the LGPS regulations. The changes remove the age discrimination identified by the McCloud ruling.
The changes may affect you as an LGPS member if:
- you were paying into the LGPS or another public service pension scheme before 1 April 2012 and
- you were paying into the LGPS between 1 April 2014 and 31 March 2022.
If you had a service break (when you were not a member of a public service scheme) of more than five years between 1 April 2012 and 31 March 2022, your later service period will not be affected, even if you meet the conditions above.
What do you need to do?
You do not need to contact us or take any action. We will work out if you are protected and notify you as follows:
- If you are a protected active or deferred member, we will include information about how the underpin might affect your pension in your 2025 annual benefit statement. We will issue this by 31 August 2025.
- If you are a protected pensioner, we will write to you if the new rules mean your pension will increase.
Further information about the judgment can be found on the McCloud member factsheet (pdf format, 650KB) or by visiting the McCloud Remedy on the national LGPS member website.
