Child Performance Licence Exemption (unlicensed performance)

An exemption from performance licensing will only be considered if:

• the child is not being paid to take part
• no other person is being paid for the child to take part (other than expenses)
• the child is not missing any school
• the child will not have performed for 4 days in the last six months (regardless of whether a licence was issued). This includes the performance that is being applied for
• The child resides in Oxfordshire

If the above is not true of your performance, you will need to apply for a child performance licence or apply for a Body of Person Approval (BOPA) as long as you meet the BOPA criteria.

Once a child has performed on 4 days in a 6-month period (in any performance, regardless of whether a licence was in place on any of those days or the child was taking part in a performance arranged under a body of persons approval) then a licence is required for any further performances.

The responsible person relying on the four-day rule should make enquiries with the child's parent to obtain written confirmation that their child has/will not have performed (in any way) on more than 3 days in the last 6 months.

It should also be noted that where the four-day rule exemption is relied upon the restrictions applicable to all performances apply.

Applying for a Child Performance Licence Exemption (unlicensed performance)

Applications should be submitted at least 21 days before the start of the performance or activity. If it is found the child does need a licence once the exemption application has been submitted, we cannot guarantee the processing of this in time for your performance.

The following should be included with the Exemption Application:

• Name, address and birth date of child/ren taking part
• Date/s, times (start and finish) & location/s for all performances
• Child Protection Policy
• Full names of all chaperones – details of issuing authority for licenced chaperones. Please note that parent chaperones are only permitted to assist and/or supervise their own  child/ren
• Risk Assessment (all locations/venues)
